申請專(zhuan)利(li)既可去國家(jia)知識產權局的專(zhuan)利(li)機構(北京),也可在國家(jia)知識產權局設在個省會(hui)的專(zhuan)利(li)代辦處。
申(shen)請專利的條件(jian)要(yao)求:
1、申請(qing)文件要齊備:請(qing)求(qiu)書(shu)、說明書(shu)、權利要求(qiu)書(shu)、摘要、圖片或者照片;
2、發明(成果(guo)(guo)),應該具有“三性”(新穎(ying)性、創造性、實用(yong)性),具體要求主要是別人沒有申請過的、成果(guo)(guo)是沒有公(gong)開(kai)過的(國際展覽(lan)會上(shang)(shang)公(gong)開(kai)、學(xue)術會議和(he)技術會議上(shang)(shang)公(gong)開(kai)、未經發明人同意而(er)泄露內(nei)容的除外);
3、國家的(de)專(zhuan)(zhuan)利(li)審(shen)(shen)查制度(du)是:對發(fa)明(ming)專(zhuan)(zhuan)利(li)申請采(cai)取(qu)早期(qi)(qi)公(gong)開,請求審(shen)(shen)查制(實質(zhi)審(shen)(shen)查);對實用新(xin)型專(zhuan)(zhuan)利(li)和外觀(guan)設計專(zhuan)(zhuan)利(li)采(cai)取(qu)形式審(shen)(shen)查。(所(suo)謂(wei)形式審(shen)(shen)查,也(ye)叫(jiao)登(deng)記(ji)制或不(bu)審(shen)(shen)查制度(du)。其審(shen)(shen)查的(de)主要內(nei)容為申請文件是否(fou)符合要求,發(fa)明(ming)是否(fou)重復。在公(gong)報上公(gong)布后,期(qi)(qi)限內(nei)若無異議即予(yu)授權)
4、把一切準備好了后(hou),當天就可以(yi)受(shou)(shou)理,當天就受(shou)(shou)法律保護。
1.專(zhuan)利(li)法(fa)(fa): 第二(er)十五(wu)條 對下(xia)列各(ge)項,不授予專(zhuan)利(li)權(quan):(一(yi))科學發現;(二(er))智力活動(dong)的(de)規則和方法(fa)(fa);(三)疾(ji)病的(de)診斷和治療方法(fa)(fa);(四)動(dong)物和植物品種;(五(wu))用原(yuan)子核變換方法(fa)(fa)獲得的(de)物質;(六)對平面(mian)印刷品的(de)圖案、色彩或者二(er)者的(de)結合作(zuo)出(chu)的(de)主要起標識(shi)作(zuo)用的(de)設計。對前款(kuan)第(四)項所列產(chan)品的(de)生產(chan)方法(fa)(fa),可以(yi)依照本(ben)法(fa)(fa)規定授予專(zhuan)利(li)權(quan);
算法應該屬于智力活動的規則和(he)方法,這個是不能授(shou)予專(zhuan)利權的。
