被授予專(zhuan)利(li)(li)權的(de)單位未(wei)與發明人(ren)、設(she)計人(ren)約定也未(wei)在其依法制定的(de)規章(zhang)制度中規定專(zhuan)利(li)(li)法第十六(liu)條規定的(de)獎勵的(de)方(fang)式和數(shu)額的(de)，應當自專(zhuan)利(li)(li)權公告(gao)之日起3個(ge)月內發給發明人(ren)或者設(she)計人(ren)獎金。
一(yi)項發(fa)明專(zhuan)利的(de)獎金最低不少于(yu)(yu)(yu)3000元；一(yi)項實用(yong)新型專(zhuan)利或者外(wai)觀設(she)計(ji)專(zhuan)利的(de)獎金最低不少于(yu)(yu)(yu)1000元。由于(yu)(yu)(yu)發(fa)明人或者設(she)計(ji)人的(de)建議被(bei)其所屬單位采納而完成的(de)發(fa)明創造，被(bei)授予專(zhuan)利權的(de)單位應當(dang)從優發(fa)給獎金。

被授予專(zhuan)(zhuan)利權的(de)單位未與(yu)發(fa)(fa)明(ming)人(ren)、設計人(ren)約定也未在其依法(fa)制定的(de)規(gui)章制度中規(gui)定專(zhuan)(zhuan)利法(fa)第十六(liu)條規(gui)定的(de)報酬的(de)方式和數額的(de)，在專(zhuan)(zhuan)利權有(you)效期限內，實(shi)施發(fa)(fa)明(ming)創造專(zhuan)(zhuan)利后(hou)；
每年應當從實施該項發明(ming)或(huo)者實用新型專利(li)的營業利(li)潤中(zhong)，提(ti)取不低(di)于2%或(huo)者從實施該項外觀設計專利(li)的營業利(li)潤中(zhong)提(ti)取不低(di)于0.2%，作為(wei)報酬給(gei)予(yu)發明(ming)人(ren)(ren)或(huo)者設計人(ren)(ren)，或(huo)者參照上述(shu)比例，給(gei)予(yu)發明(ming)人(ren)(ren)或(huo)者設計人(ren)(ren)一次性報酬。

被授予專(zhuan)利(li)(li)權的(de)單位未(wei)與發明人(ren)、設(she)計人(ren)約定也未(wei)在其依法制定的(de)規章(zhang)制度中規定專(zhuan)利(li)(li)法第十六(liu)條規定的(de)獎勵的(de)方(fang)式和數(shu)額的(de)，應當自專(zhuan)利(li)(li)權公告(gao)之日起3個(ge)月內發給發明人(ren)或者設(she)計人(ren)獎金。

被授予專(zhuan)(zhuan)利權的(de)單位未與(yu)發(fa)(fa)明(ming)人(ren)、設計人(ren)約定也未在其依法(fa)制定的(de)規(gui)章制度中規(gui)定專(zhuan)(zhuan)利法(fa)第十六(liu)條規(gui)定的(de)報酬的(de)方式和數額的(de)，在專(zhuan)(zhuan)利權有(you)效期限內，實(shi)施發(fa)(fa)明(ming)創造專(zhuan)(zhuan)利后(hou)；
每年應當從實施該項發明(ming)或(huo)者實用新型專利(li)的營業利(li)潤中(zhong)，提(ti)取不低(di)于2%或(huo)者從實施該項外觀設計專利(li)的營業利(li)潤中(zhong)提(ti)取不低(di)于0.2%，作為(wei)報酬給(gei)予(yu)發明(ming)人(ren)(ren)或(huo)者設計人(ren)(ren)，或(huo)者參照上述(shu)比例，給(gei)予(yu)發明(ming)人(ren)(ren)或(huo)者設計人(ren)(ren)一次性報酬。

第九條同(tong)樣的發(fa)明創造只能授予(yu)一(yi)項專(zhuan)利(li)權(quan)(quan)。同(tong)一(yi)申(shen)請人同(tong)日對同(tong)樣的發(fa)明創造既(ji)申(shen)請實(shi)用新型專(zhuan)利(li)又申(shen)請發(fa)明專(zhuan)利(li)，先獲得(de)的實(shi)用新型專(zhuan)利(li)權(quan)(quan)尚(shang)未(wei)終止，且(qie)申(shen)請人聲明放棄該實(shi)用新型專(zhuan)利(li)權(quan)(quan)的，可以(yi)授予(yu)發(fa)明專(zhuan)利(li)權(quan)(quan)。
